The U.S. Department of Education has begun its regulatory process for Every Student Succeeds Act (ESSA). ED sought input from stakeholders in the field on areas for regulation and implementation of the law. The January 21 deadline for comments yielded more than 370 written comments from individuals and organizations including comments from the Council for Exceptional Children.
ED has published a notice in the Federal Register regarding the establishment of a negotiated rulemaking committee to prepare proposed regulations in issues related to two topical areas: 1) assessments, and 2) supplement/ not supplant.
The notice provides the public with notice of two negotiation sessions in March and April which are open to the public. The notice requests nominations for individual negotiators who represent key stakeholder constituencies for the issues to be negotiated to serve on the committee. CEC is collaborating with the disability community to nominate negotiators. .
